Our Approach

FastpitchAI is an AI company. Our analysis gets better the more pitching data our models learn from. We use your data — with your permission — to build the most accurate pitching analysis platform in softball. This policy explains exactly what we collect, how we use it, and what you control. We believe in being upfront about everything, including AI training, rather than burying it in fine print.

Our computer vision system automatically analyzes your pitching mechanics and extracts biomechanical data from every video you submit for analysis. This includes measurements related to body movement, positioning, and timing throughout the pitching motion.

This derived data may constitute biometric information under applicable state law. See Section 4 for how we handle it.

• We do not access your device contacts, photos outside the app, or microphone without your permission
• We do not collect the content of private communications between users

2. How We Use Your Information

To Provide the Service

We use your account information, videos, and derived biomechanical data to generate your pitching analysis, deliver results, manage your account, and provide customer support.

To Improve FastpitchAI's AI — With Your Consent

FastpitchAI is an AI-powered platform. The more real pitching data our models train on, the more accurate and useful the analysis becomes for every user — including you.

With your separate, explicit opt-in consent (provided at sign-up or changed at any time), we may use your uploaded videos and derived biomechanical data to:

• Train and validate our computer vision and pitching analysis models
• Test and improve new analytical capabilities
• Develop performance benchmarks across pitching styles and skill levels
• Share anonymized motion data with trusted AI development partners under strict data use agreements

This is similar to how major platforms like Meta, TikTok, and LinkedIn use user content to improve their AI systems. Unlike those platforms, FastpitchAI requires an explicit opt-in — you are never included in AI training by default.

If you do not opt in, your data is used only to generate your personal analysis. Nothing more.

To Operate the Business

Usage analytics (aggregated and de-identified) help us understand how the product is used and where to improve it. We also use your data for security monitoring, fraud prevention, and legal compliance.

To Communicate With You

We send you analysis results, feature updates, and support responses. You can opt out of marketing emails at any time using the unsubscribe link.

3. Who We Share Your Data With

We do not sell your personal information.

4. Biomechanical and Biometric Data

The biomechanical data extracted from your pitching videos — including joint positions and movement patterns — may qualify as biometric data under US state laws including the Illinois Biometric Information Privacy Act (BIPA) and Texas CUBI.

We handle this data with extra care:

Separate written consent. We obtain standalone written consent for biomechanical data collection before analyzing any of your videos. This is a dedicated consent screen at sign-up — not buried in the Terms of Service.

No sale of biometric data. Chekket Inc. will never sell, lease, trade, or profit from your biometric or biomechanical data, under any circumstances.

Dedicated retention schedule. See Section 7 (Data Retention) and our published Biometric Data Retention Schedule for exact timelines.

Encryption and access controls. Biomechanical data is stored with the same encryption and access restrictions as your video files, plus additional access logging.

5. Minor Users' Data

Users Under 13

We comply with the Children's Online Privacy Protection Act (COPPA) and its 2025 amendments. We do not collect any personal information from children under 13 without verified parental consent.

For accounts involving users under 13:

• A parent or legal guardian creates and manages the account
• Parental consent covers video uploads, biomechanical data collection, and — if selected — AI training use
• Parents may access, correct, or delete their child's data at any time by contacting info@chekket.com
• We do not serve behavioral advertising to users under 13

Users 13–17

Parental or guardian approval is required before account activation for all users under 18. All data practices in this Privacy Policy apply equally to minor users. Parental consent decisions regarding AI training are honored until the user turns 18 and can update their own preferences.

6. International Data Storage

FastpitchAI's servers are located in the United States. If you use FastpitchAI from Canada, Japan, or Australia, your data will be transferred to and processed in the US.

Canada. This transfer is made on the basis of your consent at sign-up. Your data will be subject to US law once transferred. Canadian users retain all rights described in Section 8 of this policy.

Japan. In accordance with Japan's Act on the Protection of Personal Information (APPI), we disclose that your personal information will be transferred to the United States. Chekket Inc. maintains appropriate safeguards for this transfer. Japanese users may request disclosure of the transfer conditions by contacting info@chekket.com.

Australia. In accordance with the Australian Privacy Principles (APPs), Chekket Inc. takes reasonable steps to ensure that overseas recipients handle your information consistently with the APPs.

7. Data Retention

8. Your Privacy Rights

All rights can be exercised by emailing info@chekket.com. We acknowledge requests within 10 business days and respond substantively within 45 days (extendable by 45 days with notice for complex requests).

All Users

• Delete your account and data — email info@chekket.com
• Withdraw AI training consent — email info@chekket.com (takes effect within 90 days)
• Download your data — email info@chekket.com

California Users (CCPA / CPRA)

• Right to know — request a summary of personal information we've collected and how we've used it
• Right to delete — request deletion of your personal information
• Right to correct — request correction of inaccurate information
• Right to opt out of sharing — email info@chekket.com
• Right to limit sensitive data use — email info@chekket.com
• Right to non-discrimination — we will not discriminate against you for exercising any of these rights

Canadian Users (PIPEDA / Quebec Law 25)

• Right to access — request a copy of your personal information
• Right to correct — request corrections to inaccurate data
• Right to withdraw consent — withdraw consent to data processing at any time
• Quebec residents — additional rights under Law 25 including data portability and disclosure of automated decision-making

Japanese Users (APPI)

• Right to disclosure — request disclosure of personal information we hold
• Right to correction — request correction, addition, or deletion of personal information
• Right to suspension of use — request suspension of use or deletion of personal information

Australian Users (Privacy Act 1988)

• Right to access — request access to personal information we hold about you
• Right to correct — request correction of inaccurate, incomplete, or out-of-date information
• Right to complain — lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au

9. Data Security

We protect your data with:

• Encryption in transit: TLS 1.3 for all data transmitted between your device and our servers
• Encryption at rest: AES-256 for stored videos and biomechanical data
• Access controls: Role-based permissions — only authorized personnel can access user data
• Vendor agreements: All cloud providers and data partners are bound by Data Processing Agreements
• Security assessments: Regular reviews of our infrastructure and practices
• Incident response: Documented procedures for identifying, containing, and reporting breaches

If a security breach affects your personal information, we will notify you and the appropriate regulatory authorities as required by applicable law.

10. Changes to This Policy

We will notify you of material changes to this Privacy Policy at least 30 days before they take effect — by email and/or in-app notification.

We will not retroactively change how we use data you have already uploaded without first obtaining your fresh consent.
