Terms of Service

1. Who Can Use FastpitchAI

Age requirement. You must be at least 13 years old to use the Service.

Users under 18. If you are under 18, a parent or legal guardian must approve your account before it is activated. We will send an approval request to the email address you provide for your parent or guardian. Your account will not be activated until they approve.

Users under 13. If you are under 13, your parent or guardian must create and manage the account on your behalf and provide consent for all data uses described in these Terms.

Accurate information. You agree to provide truthful, current, and complete information when registering. You are responsible for keeping your account information up to date.

Account security. You are responsible for your login credentials and all activity that occurs under your account. Notify us immediately at info@chekket.com if you believe your account has been compromised.

2. What FastpitchAI Does

FastpitchAI is an AI-powered computer vision platform built by Chekket Inc. for softball pitchers, coaches, parents, and pitching instructors.

The Service allows you to:

• Upload pitching videos to secure cloud storage
• Receive automated biomechanical analysis of your pitching mechanics
• Track performance metrics and progress over time
• Share analysis results with coaches or team members you authorize

3. Your Content

3.1 You Own Your Videos

You keep full ownership of all videos, images, and other content you upload to FastpitchAI ("Your Content"). Chekket Inc. does not claim ownership over Your Content.

3.2 License You Grant to FastpitchAI

By uploading Your Content, you grant Chekket Inc. a worldwide, royalty-free license to:

• Store Your Content on our cloud infrastructure to deliver the Service to you
• Process Your Content through our computer vision systems to generate your pitching analysis
• Display your analysis results to you and to any coaches, parents, or team members you explicitly authorize within the app
• Derive biomechanical data from Your Content (joint positions, arm angles, stride metrics, etc.) to power the analysis features
• Use Your Content and derived biomechanical data to train, test, and improve FastpitchAI's AI models and computer vision algorithms — subject to the separate AI training consent described in Section 3.3

This is a broad license because building a better product for every pitcher requires learning from real pitching data. We are fully transparent about this from the start.

3.3 AI Training — Your Choice

Using your videos to train our AI is subject to a separate consent. During sign-up, you will be asked whether you want to contribute your data to FastpitchAI's AI training. This is optional — you have full access to all features either way.

If you consent to AI training use, your videos and biomechanical data may be used to:

• Train and validate our pitching analysis models
• Improve the accuracy of biomechanical feedback for all users
• Develop new analytical capabilities

If you do not consent, your videos are used only to generate your personal analysis results. They are never included in any training pipeline.

Changing your mind. You can update your AI training preference at any time by emailing info@chekket.com.

Important note on deletion. Once data has been incorporated into a trained model's weights, it may not be technically possible to remove it from that specific model. However, upon withdrawal of consent or account deletion, your data will be excluded from all future training activity within 90 days.

3.4 Content You Upload

You are responsible for Your Content. You may only upload content that:

• You have the right to upload (you own it or have authorization from the person in it)
• Does not contain other people without their knowledge and consent
• Complies with all applicable laws
• Does not infringe anyone's intellectual property rights

3.5 Deleting Your Content

You may delete any video at any time from within the app.

When you delete a video:

• It is removed from active storage within 30 days
• If you consented to AI training use, it is removed from future training runs within 90 days
• Backup copies may persist for up to 90 days for system recovery purposes before permanent deletion

When you close your account, all Your Content is treated as deleted under the same timelines.

4. Biomechanical Data

4.1 What We Analyze

When you upload a pitching video, FastpitchAI's computer vision system automatically analyzes your pitching mechanics and extracts biomechanical data from the footage. This includes measurements related to body movement, positioning, and timing throughout the pitching motion.

4.2 Biometric Data Notice

Some of the biomechanical data we extract may qualify as biometric data or biometric identifiers under applicable US state laws, including the Illinois Biometric Information Privacy Act (BIPA) and Texas Capture or Use of Biometric Identifier Act (CUBI).

Before we analyze any of your videos, we obtain your separate written consent for this data collection. This consent is presented as a standalone disclosure screen during sign-up — separate from your acceptance of these Terms.

4.3 We Will Never Sell Your Biometric Data

Chekket Inc. will not sell, lease, trade, or profit from your biomechanical or biometric data under any circumstances, regardless of any other provision in these Terms.

5. Minor Users

5.1 Users Under 13 — COPPA Compliance

Chekket Inc. complies with the Children's Online Privacy Protection Act (COPPA) and its 2025 amendments. We do not collect personal information from children under 13 without verified parental consent.

For users under 13, a parent or legal guardian must:

• Create and manage the account
• Provide verifiable consent for video uploads and biomechanical data collection
• Make the separate consent decision regarding AI training use on the child's behalf

Parents may review and request deletion of their child's data at any time by contacting info@chekket.com.

5.2 Users 13–17

Users between 13 and 17 may use the Service after a parent or guardian approves the account through our email-based consent process. The parent or guardian's approval covers the data uses described in these Terms.

6. Cloud Storage and Security

Chekket Inc. stores your videos and data on industry-standard cloud infrastructure. We implement technical and organizational security measures including:

• Encryption of data in transit (TLS) and at rest (AES-256)
• Role-based access controls
• Regular security assessments
• Data Processing Agreements with all cloud storage providers

No security system is perfect. While we work hard to protect your data, we cannot guarantee absolute security against all threats.

In the event of a data breach that affects your personal information, we will notify you and applicable regulatory authorities as required by law.

7. Your Privacy Rights

You have rights regarding your personal information. Our Privacy Policy describes these rights in full and how to exercise them. To submit a request, contact us at info@chekket.com — we will respond within 45 days.

8. Intellectual Property

Chekket Inc. and its licensors own all rights in the FastpitchAI Service, including the AI models, computer vision algorithms, software, and related technology. Nothing in these Terms transfers ownership of FastpitchAI's intellectual property to you.

You may not copy, reverse engineer, decompile, modify, or create derivative works of any part of the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CHEKKET INC. MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICE.

FastpitchAI's biomechanical analysis is an analytical tool — not medical advice. It is not intended to diagnose injury, prevent harm, or substitute for the advice of a qualified coach, trainer, or medical professional. Use of the Service does not create any professional advisory relationship between you and Chekket Inc.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHEKKET INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of laws provisions.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or in-app notification at least 30 days before the changes take effect.

We will not retroactively change how we use data you previously uploaded without obtaining your fresh consent. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of those Terms.
